Terms and Conditions

IMPORTANT - PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE SUBSCRIBING TO THE AccessMyLan SERVICE.

This is an agreement between Asavie Technologies Ltd. (“Asavie”), owners and operators of the AccessMyLan service (“AccessMyLan”) and is provided to you (“you”) under the terms and conditions listed. Use of the AccessMyLan service and the website AccessMyLan.com (“the AccessMyLan website”) is subject to the acceptance of these terms and conditions.

Asavie reserve the right to modify this agreement. Notifications of change will be posted on the AccessMyLan website and/or delivered by e-mail to remote users. You are responsible for reviewing these terms and conditions on a regular basis. Continued use of AccessMyLan after such changes have been notified constitutes acceptance of the amended terms and conditions.

The AccessMyLan service

AccessMyLan provides a managed service (“the Service”) to enable people authorized by you (“remote users”) to gain remote access to computer systems managed by you.

Subscribing to AccessMyLan

To use AccessMyLan, you have to complete the ‘new account’ registration process on the AccessMyLan website. This registration process will require you to provide account information to enable AccessMyLan to provide the service to you. As part of the registration you agree to provide accurate and complete information as requested by the registration process and to maintain such information in an up-to-date state via the AccessMyLan website. You may be notified if AccessMyLan finds any of the provided information incorrect and will require you to provide the correct information within seven days of notification. Failure to provide correct registration information may result in termination of the service to you and your remote users. At our sole discretion AccessMyLan may also reject any application for service that we believe is inappropriate. An account subscription is deemed active once you have provided the appropriate registration and accepted these terms and conditions as part of the registration process. You must be 18 years or older to register an account on AccessMyLan.

Service fees and payments

AccessMyLan provides a number of product offerings that can be viewed with current pricing on the AccessMyLan website. To activate an account on AccessMyLan you need to provide valid credit card details with sufficient credit available to purchase the product selected. Your account subscription will renew automatically on each subsequent renewal date unless terminated by you on the AccessMyLan website or terminated by AccessMyLan. Instructions on how to terminate an account subscription are provided on the AccessMyLan website. Your account will be billed on a monthly or yearly basis in advance depending on product options selected during registration to the credit card provided during the registration process. Account renewals will be charged at the product subscription rate posted on AccessMyLan at the time of renewal. EU consumer legislation provides for a seven day cooling off period from registration during which you may cancel your account. AccessMyLan will provide a refund of any payments received within thirty days. AccessMyLan reserves the right to amend any product features and/or pricing and to add or remove product offerings. From time to time AccessMyLan will offer evaluation accounts to enable potential customers evaluate the service. Registration for an evaluation account may require a valid credit card that will be billed on expiration of the trial unless the account is cancelled. The trial expiry scheme (whether elapsed time, time connected or traffic) will be indicated to you at time of subscription.

Acceptable Use of Service

You may not resell or use for commercial gain any aspect of the service without the express permission of Asavie.
The service may not be used for or in support of any illegal activities.
You may not interfere or attempt to interfere with the service or any other remote user to the service or to attempt to gain access to service resources not explicitly authorized to you.
The service may not be used for unauthorized transmission of intellectual property or be used for an activity that infringes on a copyright, patent, trademark, trade secret or reasonable rights to privacy.
The service may not be used to transmit any material that may be reasonably regarded as offensive.
You may not use the service to transmit unsolicited material (“Spam”).
You may not use the service to transmit viruses, worms, trojans or any other potentially malicious or destructive materials.

Privacy & Data Retention

Asavie respects your privacy and does not gather, maintain or analyze any personal information or activity except what is required for normal provision of the service. Information gathered on you or any remote user is not provided to any 3rd parties except where required to do so by law or to process payments. Please consult the AccessMyLan Privacy Policy on the AccessMyLan website for further information.

Service Availability

Asavie shall be entitled to temporarily suspend the service in the event of any breakdown, fault or malfunction of any system used in connection with the service for the purpose of correcting the breakdown, fault or malfunction without incurring any liability.

Service Support and Updates

Asavie may amend the features and functions of the service but has no obligation to inform you of or deliver to you such updates. This agreement does not provide you with any rights to support, maintenance or modifications to the service, associated software or documentation. Asavie may charge for additional features or capabilities provided in future version of the service.

Password Security

As part of the registration process you and your remote users choose a password to control access to the service. It is the sole responsibility of you and your remote users to maintain the security and privacy of password material. You are solely responsible for any and all activities that occur under your account subscription. Asavie reserves the right to disable or cancel an account or remote user where we believe the password has been compromised. Any actual or suspected unauthorized use of an account or a remote user identity must be reported to support@AccessMyLan.com. Asavie reserve the right to require a password and/or username change where a password has been compromised.

Termination

Asavie may terminate your account after seven days notice if (a) Asavie believes that you have breached the terms of this agreement (b) you have failed to provide accurate or verifiable registration information (c) you have failed to correct inaccurate registration information as required in this agreement. Asavie may decide, upon thirty days notice, at its sole discretion, to cease offering the service and provide a refund of any advance payments in respect of the period after the termination date. You may terminate your account at any time. No refund of advance payments will be made in respect of account cancellation by you unless AccessMyLan has been in breach of this agreement. Accounts may be cancelled only via the AccessMyLan website.

The materials contained on this website (such materials, include but are not limited to, the design, layout, artwork and other elements of the website and any text, logo, content, data, documentation or any other materials contained on the website) are owned or licensed by Asavie Technologies Ltd (Asavie) and are protected by copyright and trademark law, international treaties and other intellectual property rights. You may view, download, print and copy materials on this website for your own personal, informational and non-commercial use, provided that (a) you do not modify the materials (b) any copies that you make must be marked "Copyright". Asavie, the Asavie logo, AccessMyLan.com, the AccessMyLan logo, Passbridge, the Passbridge logo are trade marks of Asavie Technologies Ltd. All other trademarks, service marks, trade names and logos contained in this website are the property of their respective owners.

Warranty Disclaimer

No warranty of any kind, either expressed or implied, is made by Asavie in relation to the availability, satisfactory quality and reliability of the service. Asavie will not be liable for any interruption, disruption to, or deterioration in the quality, reliability or accuracy of the service or any technical issue that may arise by reason of the remote users use or inability to use the service supplied by Asavie. AccessMyLan is not a fault-tolerant environment and should not be used in situations where fail safe operation is required including but not limited to systems where service failure might result in death, injury or environmental damage.

Limitation of Liability

Under no circumstances will Asavie Technologies Ltd. be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of AccessMyLan regardless of the form of action.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with Irish law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.
